PLEASE READ THESE TERMS OF USE ("TERMS") CAREFULLY BEFORE USING THE SERVICE. BY USING THE SERVICE, YOU ACCEPT THESE TERMS. IF YOU DO NOT ACCEPT THESE TERMS, DO NOT USE THIS SERVICE. RALLY SPORTS CLUB RESERVES THE RIGHT TO REVISE, AMEND, OR MODIFY THESE TERMS AND OTHER POLICIES AND AGREEMENTS AT ANY TIME AND IN ANY MANNER BY UPDATING THIS PAGE.

Use of Service:

• Rally Sports Club owns the service as a whole.
• Any individual content provided by staff members or contributors who provide work to the facility, are under contract with Rally Sports Club.
• Rally Sports Club authorizes you to access, view, and download the text, graphics, images, documents, and other materials ("Content") on the service for personal, non-commercial use only.
• All copyright and proprietary notices contained in the original content must be retained by the members.
• Modifying, reproducing, publicly displaying, performing, distributing, or using the content for public or commercial purposes is prohibited.
• Using the content on any other website or networked computer environment for any purpose is prohibited.
• Unauthorized use of any content may violate copyright, trademark, and other laws. No transfer of title or ownership of content is allowed.

Attempting to compromise service security or any networked account is prohibited. You must not:

Links to third-party websites ("Third Party Sites") are provided for convenience. Rally Sports Club has not reviewed these Third-Party Sites and they are not governed by these terms or privacy policy. Use them at your own risk.

Mobile App Terms & Conditions:

By linking your device to your member account, you agree to the following terms and conditions:

• The Check-in feature is limited to participating locations.
• Device linking is limited to one device at a time.
• Devices must be used by the named member on the account.
• Additional features and functionality may use your information.
• Use of the Check-in feature requires a current picture on your member record.
• Unique identification information will be transmitted and stored in combination with your member information.
• Rally Sports Club may disable the check-in feature on your account/device.
• Sharing access to club facilities with non-members is not allowed and may result in suspension/termination.

Disclaimer

Rally Sports Club makes no representation or warranty regarding the reliability, timeliness, quality, suitability, truth, availability, accuracy, or completeness of the service or any content. Rally Sports Club does not guarantee:

• Secure, timely, uninterrupted, or error-free use of the site.
• Service meeting your requirements or expectations.
• Accuracy, reliability, or integrity of stored content.
• Quality of any products, services, information, or materials obtained through the site.
• Error correction or virus-free nature of the site or server(s).

Regardless of any conflicting provisions, Rally Sports Club shall not be held liable for any delays or interruptions in fulfilling its obligations caused by governmental emergency orders, judicial or government actions, emergency regulations, sabotage, riots, vandalism, labor strikes or disputes, fires, electrical failures, major computer hardware or software failures, equipment delivery delays, acts of third parties, or any other events beyond its reasonable control. The failure of Rally Sports Club to exercise or enforce any right or provision of these Terms shall not be considered a waiver of such right or provision. Unless expressly stated otherwise in these Terms, any modifications or waivers must be made in writing. These Terms constitute the entire agreement between The Athlete and Rally Sports Club, governing the use of this Service, and supersede any prior agreements between the individual and Rally Sports Club concerning the subject matter covered in these Terms.

Furthermore, when athletes complete a course and subscribe, we collect their data (name and email), which is securely stored using a dedicated email provider service. Your personal information will not be disclosed unless permitted by law or with your explicit consent. Subscribers agree to receive updates on Rally Sports Club related material and information, including invitations to events, services, or survey tools associated with Rally Sports Club. Users have the freedom to unsubscribe from these updates at any time.
